1. Introduction
LookFindCall.com is a business listing and lead generation platform tailored for home service providers and small businesses. It integrates robust business management features, like those of ServiceTitan, with lead generation and customer acquisition tools, similar to HomeAdvisor and Thumbtack. LookFnidCall.com’s primary product, the SimplePlan, provides tiered solutions to meet various business needs.
2. Scope of Services
SimplePlan Offerings:
- SimplePlan Basic: Business listing, professional website development, and ongoing support.
- SimplePlan Business: Includes marketing automation, lead management, and CRM tools.
- SimplePlan Pro: Adds dedicated virtual assistants, a sales team for lead conversion, and advanced advertising strategies.
Additional services such as hosting, marketing automation, and customer relationship management are provided depending on the chosen plan.
3. Ownership of Materials
- The website, graphics, programming code, and other deliverables remain the property of LookFindCall until all outstanding invoices are paid in full.
- Client-provided materials (logos, content, etc.) must have proper permissions and copyrights; LookFindCall is not responsible for copyright infringements.
4. Client Responsibilities
- Clients are responsible for providing all required materials (e.g., images, logos, and text) in a timely manner to avoid delays.
- Any delay in supplying necessary materials may result in adjusted timelines or additional fees.
5. Payment of Accounts (Invoices)
- A 100% deposit is required before commencing any work.
- Invoices for completed work must be paid in full within 14 days of issuance unless otherwise agreed upon.
- Unpaid invoices beyond 21 days may result in:
- Suspension of access to related websites or services.
- Removal of web pages.
- Legal action, including reporting to Small Claims Court, which could affect the client’s credit rating.
- Clients are liable for the full cost of all related services and third-party fees waived as part of any promotion, should payment not be completed within 21 days.
6. Refund Policy
- Due to the nature of digital services, payments for completed work, ongoing services, and hosting are non-refundable.
- Refunds will not be issued for partial months of service or for work already initiated or completed.
7. Term and Termination
- Agreements remain in effect until terminated in writing by either party.
- Termination by the client requires a 30-day written notice.
- Non-payment or breach of these terms allows LookFindCall to terminate services immediately.
- Upon termination:
- All licenses and access to LookFindCall services cease.
- Clients must settle any outstanding balances within 60 days.
- LookFindCall will archive all website content for three (3) years, after which it will be permanently deleted.
8. Service Guarantees and Limitations
- LookFindCall endeavors to ensure compatibility with major browsers and functionality on provided servers. However, no guarantees are made regarding uninterrupted service or compatibility with all software and devices.
- LookFindCall is not liable for any loss of earnings, turnover, or damages arising from delays, technical issues, or misuse of the services provided.
9. Security
Clients are responsible for safeguarding their login credentials. LookFindCall is not liable for unauthorized access resulting from client negligence.
10. Variations
Changes to project requirements after agreement may incur additional charges. LookFindCall reserves the right to accept or reject such changes.
11. Complaints Procedure
- Clients should report issues through LookFindCall’s support channels, providing sufficient information to locate and address the problem.
- Complaints are reviewed within 24 hours, and a resolution is sought within 30 days.
12. Liability and Indemnity
- LookFindCall is not liable for any losses incurred due to errors, delays, or third-party services.
- Clients agree to indemnify LookFindCall against claims resulting from misuse of services or unauthorized use of copyrighted materials provided by the client.
13. SimplePlan Special Terms
- SimplePlan Basic provides essential tools for establishing an online presence.
- SimplePlan Business includes advanced tools for lead generation and customer relationship management.
- SimplePlan Pro offers enhanced services like virtual assistants and advanced advertising.
14. Feedback and User-Supplied Information
By providing feedback or content, clients grant LookFindCall a perpetual, royalty-free license to use, reproduce, and distribute the provided materials.
15. Hosting Services
will recommend hosting providers but is not liable for any issues related to third-party hosting, including downtime or data loss.
16. Amendments to Terms
LookFindCall reserves the right to amend these Terms and Conditions. Clients will be notified of any significant changes.
17. Governing Law
These Terms and Conditions are governed by the laws of Delaware.
